1. Acceptance of Terms

By accessing or using Runners In Need ("the platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

2. Description of Service

Runners In Need is a free community bulletin board that connects people who want to donate running gear with organizations that need it. The platform is a personal project operated by Nick Coury. It is provided "as is" at no cost to anyone.

The platform is passive — organizations post needs, donors browse and pledge. No money changes hands on this platform. There are no fees, no payment processing, and no donations to the platform itself.

3. User Responsibilities

By using the platform, you agree to:

• Provide accurate and truthful information in your listings and profile
• Use the platform only for lawful purposes
• Not post fraudulent, misleading, or deceptive content
• Not use the platform to harass, spam, or abuse other users
• Not attempt to buy or sell goods through the platform — all gear must be donated freely

4. Donor Responsibilities

If you pledge gear through the platform, you certify that:

• Items are in safe, wearable condition
• Items have not been recalled by the manufacturer
• Items have been cleaned before donation
• You have the right to give the items away
• You are not donating items that pose a known safety hazard

The platform does not inspect, verify, recommend, or warrant any donated goods. Donors are solely responsible for the condition and safety of items they donate.

5. Organization Responsibilities

Organizations that receive donated gear are responsible for inspecting all items before distributing them to end recipients. Organizations should verify that items are safe, clean, and appropriate for their intended use. The platform makes no guarantees about the quality, safety, or fitness of any donated goods.

6. No Warranties

The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. Without limitation, the platform makes no guarantees regarding:

• The quality, safety, or condition of any donated goods
• The reliability, identity, or good faith of any user
• The availability or uptime of the platform
• The accuracy or completeness of any listing or user-provided information
• Whether any donation will actually be fulfilled

7. Limitation of Liability

To the fullest extent permitted by law, the platform and its operator shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. This includes, without limitation, damages arising from:

• Injury or harm caused by donated goods
• Interactions between users
• Loss of data or service interruptions
• Reliance on any information provided through the platform

This is a free service. No money is exchanged. The platform's total liability to you for any claim arising from your use of the platform is $0.

8. Indemnification

You agree to indemnify, defend, and hold harmless the platform and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your content, your donations, or your violation of these terms.

9. User Content

You retain ownership of any content you post on the platform, including listings, descriptions, and images. By posting content, you grant the platform a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content solely for the purpose of operating the platform.

You are solely responsible for the content you post. The platform may remove any content at its discretion without notice.

10. Section 230 Notice

Under Section 230 of the Communications Decency Act (47 U.S.C. § 230), the platform is not the publisher or speaker of user-generated content. Listings, messages, and other content posted by users represent the views of those users, not the platform. The platform does not endorse, verify, or take responsibility for any user-generated content.

11. Privacy

Your use of the platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Modifications

These terms may be updated from time to time. Changes will be posted on this page with an updated date. Your continued use of the platform after changes are posted constitutes your acceptance of the revised terms.
